1. How Can I Get "Custody" of The Children?
The state of Florida decides who the children will live with based on the "Best Interests of The Child." This is determined by examining many factors as to where the child would prosper most. Both parents will be considered on an equal standing.
2. Am I Going To Get Child Support? How Much?
The Short answer is YES. The child support laws in the State of Florida are enforced vigorously by the courts. Additionally, the Federal Government has created laws that protect you from a spouse that attempts to run to another state to avoid their child support obligation. Lastly, the amount of support is determined by using a formula that applies the earnings of both parties to determine the amount of support.
3. Can I Get Alimony From My Spouse?
In the state of Florida in order to qualify for alimony (spousal support) the marriage must have lasted for a substantial amount of time. Additionally, one spouse must have the "need" for the support while the other spouse has the "ability to pay" the support.
4. How Long Does It Take?
The time varies greatly based on how contested the issues in the divorce are. It can range from approximately 2 months to over 1 year in extraordinary situations.
